Terms and Conditions for Waste Removal Holland Park Services

These Terms and Conditions govern the provision of waste removal and related services by Waste Removal Holland Park to domestic and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business or organisation requesting and/or paying for the services.

Company, we, us, our means Waste Removal Holland Park, the waste collection service provider.

Services means any waste removal, rubbish clearance, bulky waste collection, garden waste removal, office clearance, or related services provided by the Company.

Waste means any items or materials presented for collection, including household waste, commercial waste, garden waste, and bulky items, subject to the exclusions set out in these Terms and Conditions.

Contract means the agreement between the Customer and the Company for the supply of Services, incorporating these Terms and Conditions.

2. Scope of Services

The Company provides waste removal and related services within its operating area, which includes Holland Park and surrounding districts. The exact type and scope of the Services will be as described in the quotation or booking confirmation provided to the Customer.

The Services may include, but are not limited to, house clearances, office clearances, one-off collections, regular waste collections, garden waste disposal and bulky item removals. The Company reserves the right to refuse to collect any items that are prohibited by law or that fall outside the agreed scope of work.

3. Booking Process

3.1 Bookings may be made by telephone or other communication methods as made available by the Company from time to time. All bookings are subject to availability and acceptance by the Company.

3.2 When making a booking, the Customer must provide accurate and complete information, including the collection address, access details, type and approximate volume or weight of waste, any special handling requirements and preferred date and time for collection.

3.3 The Company may provide an estimate based on the information provided by the Customer. This estimate is not binding if the information provided is inaccurate or incomplete, or if the nature or volume of the waste differs materially from that described at the time of booking.

3.4 The Contract is formed when the Company confirms the booking to the Customer, either verbally or in writing. The Company reserves the right to decline any booking request at its sole discretion.

4. Access and Customer Responsibilities

4.1 The Customer is responsible for providing safe, adequate and lawful access to the collection address at the agreed time. This includes arranging any necessary permissions, parking facilities or entry codes, and ensuring that our team can safely reach the waste.

4.2 The Customer must ensure that the waste is presented in a safe and accessible manner, and that it does not contain prohibited items as set out in these Terms and Conditions or in any applicable law or regulation.

4.3 If access is obstructed, unsafe, or otherwise not as described at the time of booking, the Company may, at its sole discretion, cancel the visit, re-schedule the collection or apply additional charges to cover time lost, waiting time, additional labour or alternative access arrangements.

4.4 The Customer warrants that they either own the waste items to be removed or have the full authority and consent of the legal owner to authorise their removal and disposal.

5. Pricing and Quotations

5.1 Prices for Services are based on factors such as the volume and type of waste, weight, access conditions, labour time and disposal costs. The Company will provide the Customer with an estimate or quotation before carrying out the Services.

5.2 Any quotation provided before the collection is an estimate only and not a fixed price if it is based solely on the Customer's description without on-site inspection. The final price may be adjusted on site once our team has assessed the waste and the working conditions.

5.3 If the actual volume, weight or nature of the waste differs from that described by the Customer, or if access is more difficult than indicated, the Company may revise the price. In such cases, the Customer will be informed of any adjustment before the work proceeds. If the Customer does not accept the revised price, the Company may cancel the Service and may charge a call-out or cancellation fee.

5.4 All prices are exclusive or inclusive of VAT as specified by the Company. Any applicable taxes, charges or levies will be stated to the Customer where reasonably practicable.

6. Payments and Invoicing

6.1 Unless otherwise agreed in writing, payment is due in full on completion of the Service on the day of collection. The Company may, at its discretion, require payment in advance for certain bookings or from certain Customers.

6.2 The Company accepts payment by the methods it communicates to the Customer, which may include cash, card payment or bank transfer. The Company reserves the right to change accepted payment methods from time to time.

6.3 Where the Customer is a business or organisation with an approved account, payment terms will be as agreed in writing. If no specific terms are agreed, payment will be due within 14 days of the date of invoice.

6.4 If the Customer fails to make payment on the due date, the Company reserves the right to suspend further Services, charge interest on overdue sums at the statutory rate and recover any reasonable costs incurred in seeking to recover the debt.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company directly. Cancellations or changes are only effective once acknowledged by the Company.

7.2 For standard bookings, if the Customer cancels more than 24 hours before the scheduled collection time, no cancellation charge will usually apply. If the Customer cancels within 24 hours of the scheduled time, the Company may charge a cancellation fee to cover allocated resources and lost work.

7.3 If our team attends the collection address at the agreed time and is unable to complete the Service due to the Customer's act or omission, including but not limited to lack of access, unsafe conditions or absence of an authorised person where required, the Company may charge a call-out or wasted journey fee.

7.4 The Company reserves the right to cancel or re-schedule a booking in the event of circumstances beyond its reasonable control, including but not limited to severe weather, traffic disruption, staff illness, vehicle breakdown, or legal or regulatory restrictions. In such cases, the Company will attempt to notify the Customer as soon as reasonably possible and offer an alternative time or a refund of any pre-paid sums.

8. Waste Regulations and Prohibited Items

8.1 The Company operates in accordance with applicable UK waste management legislation and regulations. All waste collected will be transported and disposed of at authorised facilities, and the Company will take reasonable steps to ensure reuse, recycling and recovery where possible.

8.2 The Customer must not present hazardous or prohibited waste for collection unless this has been expressly agreed in advance and the Company is licensed and equipped to handle such waste. Hazardous or prohibited waste may include, without limitation: asbestos, chemicals, solvents, oils, clinical or medical waste, explosives, gas cylinders, radioactive materials, contaminated containers, tyres in certain quantities, and electrical or electronic equipment not covered by the agreed scope.

8.3 If prohibited or hazardous items are found within the waste during or after collection, the Company may refuse to collect such items, may require the Customer to arrange separate specialised disposal, or may charge additional fees to cover any extra handling, transport, treatment and disposal costs incurred.

8.4 The Customer is responsible for ensuring that any confidential or sensitive materials are removed or destroyed before presenting waste for collection. The Company does not accept liability for any loss or breach of confidentiality arising from documents or data included in waste collected.

9. Performance of Services

9.1 The Company will use reasonable care and skill in providing the Services. Collection times and dates are given in good faith but are approximate only, and time for performance is not of the essence unless expressly agreed in writing.

9.2 The Company will endeavour to minimise disruption and will take reasonable care when removing waste from a property. However, the Customer acknowledges that minor scuffs, marks or wear may sometimes occur when removing large or heavy items from confined spaces, and the Company will not be liable for such minor damage unless caused by negligence.

9.3 The Customer must inspect the area after completion of the Service and notify the team immediately of any concerns. If the Customer is not present, the Service will be deemed to have been completed satisfactorily unless the Customer notifies the Company of an issue within a reasonable period after the visit.

10. Liability and Limitations

10.1 Nothing in these Terms and Conditions excludes or limits the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

10.2 Subject to clause 10.1, the Company's total aggregate liability to the Customer in respect of any claim arising out of or in connection with the Contract, whether in contract, tort or otherwise, shall not exceed the total price paid or payable by the Customer for the specific Service giving rise to the claim.

10.3 The Company will not be liable for any indirect, consequential or special loss, or for any loss of profit, revenue, business, goodwill or anticipated savings, whether such loss arises directly or indirectly.

10.4 The Company will not be responsible for any loss or damage arising from incorrect, incomplete or misleading information provided by the Customer, or from any failure by the Customer to comply with these Terms and Conditions.

10.5 The Customer shall be responsible for and shall indemnify the Company against any claims, costs, damages or expenses arising from the Customer's breach of the Contract, including presenting prohibited waste, lack of authority to dispose of items, or unsafe access conditions.

11. Complaints and Dispute Resolution

11.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue and any supporting information.

11.2 The Company will investigate complaints promptly and will seek to resolve them in a fair and reasonable manner. Where appropriate, the Company may offer to repeat the Service or provide a partial refund as a gesture of goodwill, without admission of liability.

11.3 If a dispute cannot be resolved informally, either party may consider taking further steps in accordance with their legal rights under the governing law and jurisdiction set out in these Terms and Conditions.

12. Data Protection and Privacy

12.1 The Company will handle any personal data provided by the Customer in connection with the Services in accordance with applicable data protection laws.

12.2 Personal data will be used for purposes such as managing bookings, delivering Services, processing payments, administering accounts, and complying with legal obligations. The Company will take reasonable technical and organisational measures to protect such data against unauthorised access, loss or misuse.

13. Changes to Terms and Services

13.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to the Customer and will apply to new bookings made after that date.

13.2 The Company may modify, suspend or withdraw any aspect of its Services where necessary for operational, legal or safety reasons. Where such changes materially affect an existing booking, the Company will endeavour to notify the Customer in advance and may offer an alternative or a refund where appropriate.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or relating to these Terms and Conditions, the Contract or the provision of the Services.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, such provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

15.2 The Contract is between the Company and the Customer. No other person shall have any rights to enforce any of its terms.

15.3 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy, nor shall any single or partial exercise of any such right or remedy prevent any further exercise of it.

15.4 The Customer may not assign, transfer or subcontract any of their rights or obligations under the Contract without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where necessary to provide the Services efficiently, provided that this does not reduce the level of service to the Customer.

15.5 These Terms and Conditions, together with any quotation or booking confirmation issued by the Company, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.
